amac\u0131; turist rehberli\u011fi mesle\u011fine kabule, mesle\u011fin icras\u0131na ve turist rehberli\u011fi meslek kurulu\u015flar\u0131n\u0131n kurulu\u015f ve i\u015fleyi\u015fine ili\u015fkin usul ve esaslar\u0131 d\u00fczenlemektir.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(2<\/strong>) Bu Kanun; turist rehberli\u011fi mesle\u011fine kabule, meslek i\u00e7i e\u011fitime ve mesle\u011fin icras\u0131na, turist rehberleri odalar\u0131 ile turist rehberleri odalar\u0131 birliklerinin kurulu\u015funa, organlar\u0131n\u0131n niteliklerine ve se\u00e7imlerine, organl\u0131k niteli\u011fini yitirme h\u00e2l ve usullerine, g\u00f6rev ve yetkilerine, \u00e7al\u0131\u015fma usullerine, \u00fcyeleri ile olan kar\u015f\u0131l\u0131kl\u0131 hak ve y\u00fck\u00fcml\u00fcl\u00fcklerine, gelir ve giderleri ile b\u00fct\u00e7elerine, K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131n\u0131n mesle\u011fe ili\u015fkin g\u00f6rev ve yetkilerine, meslek kurulu\u015flar\u0131yla i\u015f birli\u011fine ve turist rehberli\u011fi meslek kurulu\u015flar\u0131n\u0131n Bakanl\u0131k\u00e7a denetlenmesine ili\u015fkin usul ve esaslar\u0131 kapsar.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Tan\u0131mlar<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>MADDE 2 \u2013 (1)<\/strong> Bu Kanunun uygulanmas\u0131nda;<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>a) Bakanl\u0131k:<\/strong> K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131n\u0131,<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>b) Birlik:<\/strong> Turist rehberleri odalar\u0131 birliklerini,<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>c) \u00c7al\u0131\u015fma Kart\u0131:<\/strong> Eylemli turist rehberlerine, kay\u0131tl\u0131 olduklar\u0131 oda taraf\u0131ndan bir y\u0131l s\u00fcreyle ge\u00e7erli olmak \u00fczere mesle\u011fi fiilen icra edebileceklerine ili\u015fkin olarak verilen izin belgesini,<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>\u00e7) Eylemli Turist Rehberi:<\/strong> \u00c7al\u0131\u015fma kart\u0131 sahibi olup fiilen turist rehberli\u011fi hizmeti sunma hak ve yetkisine sahip turist rehberini,<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>d) Eylemsiz Turist Rehberi:<\/strong> Ruhsatname sahibi olup \u00e7al\u0131\u015fma kart\u0131 olmayan turist rehberini,<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>e) Meslek:<\/strong> Turist rehberli\u011fi mesle\u011fini,<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>f) Meslek Kurulu\u015flar\u0131:<\/strong> Turist rehberleri odalar\u0131 ve birliklerini,<\/span><br \/>\n<span style=\"font-family: Ruhsatname:<\/strong> Mesle\u011fe kabul ko\u015fullar\u0131n\u0131 ta\u015f\u0131yan turist rehberlerine Bakanl\u0131k taraf\u0131ndan verilen belgeyi,<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>h) Turist Rehberi:<\/strong> Bu Kanun h\u00fck\u00fcmleri uyar\u0131nca mesle\u011fe kabul edilerek turist rehberli\u011fi hizmetini sunma hak ve yetkisine sahip olan ger\u00e7ek ki\u015fiyi,<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>\u0131) Turist Rehberli\u011fi Hizmeti:<\/strong> Seyahat acental\u0131\u011f\u0131 faaliyeti niteli\u011finde olmamak kayd\u0131yla ki\u015fi veya grup h\u00e2lindeki yerli veya yabanc\u0131 turistlerin gezi \u00f6ncesinde se\u00e7mi\u015f olduklar\u0131 dil kullan\u0131larak \u00fclkenin k\u00fclt\u00fcr, turizm, tarih, \u00e7evre, do\u011fa, sosyal veya benzeri de\u011ferleri ile varl\u0131klar\u0131n\u0131n k\u00fclt\u00fcr ve turizm politikalar\u0131 do\u011frultusunda tan\u0131t\u0131larak gezdirilmesini veya seyahat acentalar\u0131 taraf\u0131ndan d\u00fczenlenen turlar\u0131n gezi program\u0131n\u0131n seyahat acentas\u0131n\u0131n yaz\u0131l\u0131 belgelerinde tan\u0131mlad\u0131\u011f\u0131 ve t\u00fcketiciye sat\u0131ld\u0131\u011f\u0131 \u015fekilde y\u00fcr\u00fct\u00fcl\u00fcp acenta ad\u0131na y\u00f6netilmesini, ifade eder.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>\u0130K\u0130NC\u0130 B\u00d6L\u00dcM<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Turist Rehberli\u011fi<\/strong><\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Mesle\u011fe Kabul<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>MADDE 3 \u2013 (1)<\/strong> Turist rehberi unvan\u0131 mesle\u011fe kabulle kazan\u0131l\u0131r ve mesle\u011fe kabul i\u00e7in a\u015fa\u011f\u0131daki ko\u015fullar aran\u0131r:<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>a)<\/strong> T\u00fcrkiye Cumhuriyeti vatanda\u015f\u0131 olmak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>b)<\/strong> Ba\u015fvuru tarihi itibar\u0131yla onsekiz ya\u015f\u0131n\u0131 doldurmu\u015f olmak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>c)<\/strong> \u00dcniversitelerin turist rehberli\u011fi b\u00f6l\u00fcmlerinin \u00f6nlisans, lisans veya y\u00fcksek lisans programlar\u0131ndan mezun olmak veya \u00fcniversitelerin turist rehberli\u011fi b\u00f6l\u00fcm\u00fc d\u0131\u015f\u0131ndaki di\u011fer b\u00f6l\u00fcmlerinden en az lisans d\u00fczeyinde mezun olduktan sonra, birliklerin ve T\u00fcrkiye Seyahat Acentalar\u0131 Birli\u011finin ortak \u00f6nerileri ve Bakanl\u0131\u011f\u0131n onay\u0131yla turizm sekt\u00f6r\u00fcn\u00fcn ihtiya\u00e7lar\u0131 da dikkate al\u0131narak belirlenen dillerde, gerekti\u011fi h\u00e2llerde belirlenen b\u00f6lgelerde, y\u00f6netmelikle kurs ve s\u0131navlara ili\u015fkin belirlenen usul ve esaslar \u00e7er\u00e7evesinde Bakanl\u0131\u011f\u0131n g\u00f6zetimi ve denetimi alt\u0131nda birlikler taraf\u0131ndan d\u00fczenlenen \u00fclkesel veya b\u00f6lgesel turist rehberli\u011fi sertifika program\u0131n\u0131 ba\u015far\u0131yla tamamlamak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>\u00e7)<\/strong> Birliklerin ve T\u00fcrkiye Seyahat Acentalar\u0131 Birli\u011finin ortak \u00f6nerileri ve Bakanl\u0131\u011f\u0131n onay\u0131 ile belirlenen yabanc\u0131 dillerden birinde, Bakanl\u0131\u011f\u0131n g\u00f6zetim ve denetimi alt\u0131nda yapaca\u011f\u0131 veya konusunda uzmanla\u015fm\u0131\u015f kamu kurum veya kurulu\u015flar\u0131na yapt\u0131raca\u011f\u0131 yabanc\u0131 dil s\u0131nav\u0131nda ba\u015far\u0131l\u0131 olmak veya y\u00f6netmelikle belirlenen yabanc\u0131 dil yeterlik belgelerinden birine sahip olmak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>d)<\/strong> Birlikler taraf\u0131ndan Bakanl\u0131\u011f\u0131n g\u00f6zetim ve denetimi alt\u0131nda d\u00fczenlenen uygulama gezisini tamamlamak ve gezi sonunda yap\u0131lan s\u0131navda ba\u015far\u0131l\u0131 olmak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>e)<\/strong> 26\/9\/2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanununun 53 \u00fcnc\u00fc maddesinde belirtilen s\u00fcreler ge\u00e7mi\u015f olsa bile kasten i\u015flenen bir su\u00e7tan dolay\u0131 bir y\u0131l veya daha fazla s\u00fcreyle hapis cezas\u0131na ya da affa u\u011fram\u0131\u015f olsa bile Devletin g\u00fcvenli\u011fine kar\u015f\u0131 su\u00e7lar, Anayasal d\u00fczene ve bu d\u00fczenin i\u015fleyi\u015fine kar\u015f\u0131 su\u00e7lar, milli savunmaya kar\u015f\u0131 su\u00e7lar, Devlet s\u0131rlar\u0131na kar\u015f\u0131 su\u00e7lar ve casusluk, zimmet, irtikap, r\u00fc\u015fvet, h\u0131rs\u0131zl\u0131k, doland\u0131r\u0131c\u0131l\u0131k, sahtecilik, g\u00fcveni k\u00f6t\u00fcye kullanma, hileli iflas, ihaleye fesat kar\u0131\u015ft\u0131rma, edimin ifas\u0131na fesat kar\u0131\u015ft\u0131rma, su\u00e7tan kaynaklanan malvarl\u0131\u011f\u0131 de\u011ferlerini aklama veya ka\u00e7ak\u00e7\u0131l\u0131k su\u00e7lar\u0131ndan; bu Kanuna veya 21\/7\/1983 tarihli ve 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanununa muhalefetten mahk\u00fbm olmamak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>f)<\/strong> Daha \u00f6nce meslekten \u00e7\u0131kar\u0131lmam\u0131\u015f olmak.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(2)<\/strong> Mesle\u011fe kabul ba\u015fvurusu Bakanl\u0131\u011fa yap\u0131l\u0131r. Bakanl\u0131k, otuz g\u00fcn i\u00e7inde gerekli incelemeleri yapar, ba\u015fvuruyu kabul etti\u011fi takdirde ruhsatnameyi d\u00fczenler, ba\u015fvuruyu reddetti\u011fi h\u00e2llerde ret karar\u0131n\u0131 gerek\u00e7esi ile birlikte ba\u015fvuru sahibine bildirir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(3)<\/strong> Mesle\u011fe kabul ko\u015fullar\u0131n\u0131 ta\u015f\u0131mamalar\u0131na ra\u011fmen mesle\u011fe kabul edilmi\u015f olanlar, mesle\u011fe kabul\u00fc engelleyen bir su\u00e7tan h\u00fck\u00fcm giyenler ile mesle\u011fe engel h\u00e2li ortaya \u00e7\u0131kanlar Bakanl\u0131k karar\u0131 ile meslekten \u00e7\u0131kar\u0131l\u0131r.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Mesle\u011fin \u0130cras\u0131, Odaya \u00dcyelik ve Meslek Sicilleri<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>MADDE 4 \u2013 (1)<\/strong> Meslek, bu maddede belirtilen usul ve esaslar \u00e7er\u00e7evesinde serbest meslek \u015feklinde veya 22\/5\/2003 tarihli ve 4857 say\u0131l\u0131 \u0130\u015f Kanunu h\u00fck\u00fcmlerine tabi olarak icra edilebilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(2)<\/strong> Turist rehberlerinin, yerle\u015fim yerinin bulundu\u011fu ilde kurulmu\u015f odalardan birine, yerle\u015fim yeri olan ilde oda kurulmam\u0131\u015fsa en yak\u0131n ilde kurulmu\u015f odalardan birine \u00fcye olmalar\u0131 zorunludur. Hangi odalar\u0131n hangi illerdeki turist rehberlerini \u00fcye olarak kaydedebilecekleri Bakanl\u0131k\u00e7a belirlenir. Turist rehberleri birden fazla odaya \u00fcye olamaz. Turist rehberlerinin oda \u00fcyeli\u011fine kabul\u00fc i\u00e7in mesle\u011fe kabul edilerek ruhsatname alm\u0131\u015f ve mesle\u011fe kabul ko\u015fullar\u0131n\u0131 kaybetmemi\u015f olmalar\u0131 gerekir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(3)<\/strong> Eylemli ve eylemsiz turist rehberlerinin ad, soyad ve sicil numaralar\u0131 ilgili birli\u011fin resm\u00ee internet sitesinde yay\u0131nlan\u0131r. Meslek sadece eylemli turist rehberleri taraf\u0131ndan icra edilebilir. Eylemli turist rehberi olabilmek i\u00e7in bir y\u0131l s\u00fcreyle ge\u00e7erli olan \u00e7al\u0131\u015fma kart\u0131n\u0131n al\u0131nmas\u0131 zorunludur. Odaya \u00fcyelik ko\u015fullar\u0131n\u0131 kaybetmi\u015f veya odaya kar\u015f\u0131 y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmemi\u015f olanlara \u00e7al\u0131\u015fma kart\u0131 verilmez. \u00c7al\u0131\u015fma kart\u0131 almayan veya eylemsiz turist rehberi olarak kalmak \u00fczere yaz\u0131l\u0131 beyanda bulunan turist rehberleri eylemsiz turist rehberi olarak sicile i\u015flenir. Eylemsiz turist rehberleri, meslek kurulu\u015flar\u0131 organlar\u0131n\u0131n se\u00e7imlerinde oy kullanamaz ve bu organlarda g\u00f6rev alamazlar. Aral\u0131ks\u0131z sekiz y\u0131l s\u00fcreyle eylemsiz turist rehberi olarak kalanlar\u0131n eylemli turist rehberi olabilmeleri i\u00e7in, Bakanl\u0131k taraf\u0131ndan yap\u0131lan s\u0131nava kat\u0131larak ba\u015far\u0131l\u0131 olmalar\u0131 gerekir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(4)<\/strong> Eylemli turist rehberlerinin \u00f6deyecekleri aidat, onalt\u0131 ya\u015f\u0131n\u0131 doldurmu\u015f olanlar i\u00e7in belirlenen ayl\u0131k asgari \u00fccretin br\u00fct tutar\u0131n\u0131n y\u00fczde yirmisinden fazla olamaz. Eylemsiz turist rehberleri, eylemli turist rehberlerinin \u00f6dedi\u011fi aidat\u0131n be\u015fte biri oran\u0131nda aidat \u00f6der. Turist rehberleri ilgili birlik taraf\u0131ndan y\u0131ll\u0131k olarak belirlenen oda aidat\u0131n\u0131 iki e\u015fit taksit h\u00e2linde \u00fcyesi bulunduklar\u0131 odaya \u00f6derler. S\u00fcresi i\u00e7inde \u00f6denmeyen aidatlar kanuni faizi ile birlikte genel h\u00fck\u00fcmlere g\u00f6re tahsil edilir. \u0130stisnas\u0131z t\u00fcm aidat al\u0131nmayacak h\u00e2ller, Birlik taraf\u0131ndan belirlenir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(5)<\/strong> Meslek, sadece \u00e7al\u0131\u015fma kart\u0131nda belirtilen yabanc\u0131 dillerde veya y\u00f6netmeli\u011fin izin verdi\u011fi h\u00e2llerde T\u00fcrk\u00e7e olarak hukuka ve meslek etik ilkelerine uygun olarak icra edilir. Turist rehberleri mesleki onur ve itibarla ba\u011fda\u015fmayan herhangi bir faaliyet veya eylemde bulunamazlar. Mesle\u011fin icras\u0131nda T\u00fcrkiye\u2019nin k\u00fclt\u00fcr, turizm, tarih, \u00e7evre, do\u011fa, sosyal ve benzeri de\u011ferlerinin ve varl\u0131klar\u0131n\u0131n, Bakanl\u0131\u011f\u0131n k\u00fclt\u00fcr ve turizm politikalar\u0131 do\u011frultusunda tan\u0131t\u0131lmas\u0131 esast\u0131r. Meslek etik ilkeleri y\u00f6netmelikle belirlenir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(6)<\/strong> Turist rehberleri; tur, paket tur, ula\u015f\u0131m veya konaklama gibi seyahat acental\u0131\u011f\u0131 faaliyeti kapsam\u0131na giren hizmetleri vermemek ko\u015fuluyla yaln\u0131zca turist rehberli\u011fi hizmeti sunabilir ve mesle\u011fe ili\u015fkin nitelik ve \u00f6zelliklerini g\u00f6stermek \u00fczere y\u00f6netmelikle belirlenen usul ve esaslar \u00e7er\u00e7evesinde reklam ve tan\u0131t\u0131m yapabilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(7)<\/strong> Meslek sicilleri odalar taraf\u0131ndan tutulur ve sicil i\u015flemleri gecikmeksizin ilgili birli\u011fe bildirilir. Birlik, veri taban\u0131 olu\u015fturur ve bu veri taban\u0131n\u0131 Bakanl\u0131\u011f\u0131n kullan\u0131m\u0131na sunar.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Disiplin Cezalar\u0131 ve Soru\u015fturma Usul\u00fc<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>MADDE 5 \u2013 (1)<\/strong> Mesle\u011fini bu Kanun h\u00fck\u00fcmlerine uygun olarak icra etmeyen ve meslek kurallar\u0131 ile etik ilkelerine uymayan turist rehberleri hakk\u0131nda a\u015fa\u011f\u0131daki disiplin cezalar\u0131 uygulan\u0131r:<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>a)<\/strong> Uyarma cezas\u0131; mesle\u011fin icras\u0131nda daha dikkatli davranmas\u0131 gerekti\u011finin turist rehberine yaz\u0131l\u0131 olarak bildirilmesidir. K\u0131nama cezas\u0131 a\u015fa\u011f\u0131daki h\u00e2llerde verilir:<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>1)<\/strong> T\u00fcketicinin yan\u0131lt\u0131lmas\u0131 suretiyle i\u015f al\u0131nmas\u0131.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>2)<\/strong> Fiilin niteli\u011fi ve sonu\u00e7lar\u0131 itibar\u0131yla daha a\u011f\u0131r bir disiplin cezas\u0131n\u0131 gerektirmedi\u011fi h\u00e2llerde i\u015fin taahh\u00fcde ayk\u0131r\u0131 olarak ifa edilmesi.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>3)<\/strong> Meslek etik ilkelerine ayk\u0131r\u0131 davran\u0131lmas\u0131.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>4)<\/strong> Turist rehberli\u011fi s\u00f6zle\u015fmesi yapmadan veya taban \u00fccretin alt\u0131nda \u00e7al\u0131\u015f\u0131lmas\u0131.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>5)<\/strong> Uyarma cezas\u0131n\u0131n uyguland\u0131\u011f\u0131 tarihten itibaren alt\u0131 ay i\u00e7inde ikinci kez uyarma cezas\u0131 gerektiren bir fiilin i\u015flenmesi.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>c)<\/strong> Meslekten ge\u00e7ici men cezas\u0131; turist rehberinin mesle\u011fi icra etmesinin bir aydan bir y\u0131la kadar yasaklanmas\u0131d\u0131r. Meslekten ge\u00e7ici men cezas\u0131 a\u015fa\u011f\u0131daki h\u00e2llerde verilir:<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>1)<\/strong> 14\/9\/1972 tarihli ve 1618 say\u0131l\u0131 Seyahat Acentalar\u0131 ve Seyahat Acentalar\u0131 Birli\u011fi Kanununun 30 uncu maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 h\u00fck\u00fcmleri sakl\u0131 kalmak \u00fczere hakl\u0131 veya zorunlu bir neden olmaks\u0131z\u0131n turun s\u00fcre ve g\u00fczerg\u00e2h\u0131n\u0131n de\u011fi\u015ftirilmesi.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>2)<\/strong> Yetkililerce yap\u0131lan denetimlerde bilgi vermekten ka\u00e7\u0131n\u0131lmas\u0131.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>3)<\/strong> Ger\u00e7e\u011fin gizlenmesi, yalan veya eksik bilgi verilmesi.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>4)<\/strong> Turist gruplar\u0131na veya turistik kurulu\u015flara kas\u0131tl\u0131 olarak zarar verilmesi.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>5)<\/strong> Turizm meslek kurulu\u015flar\u0131na, y\u00f6neticilerine, \u00e7al\u0131\u015fanlar\u0131na veya mesle\u011fe kar\u015f\u0131 g\u00fcven ve itibar\u0131 zedeleyecek veya turizme zarar verecek nitelikte haks\u0131z s\u00f6z ve davran\u0131\u015flarda veya seyahat acental\u0131\u011f\u0131 niteli\u011finde faaliyette bulunulmas\u0131.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>6)<\/strong> Kanuni istisnalar sakl\u0131 olmak \u00fczere mesle\u011fin \u00e7al\u0131\u015fma kart\u0131 al\u0131nmadan veya \u00e7al\u0131\u015fma kart\u0131nda belirtilen dil veya diller d\u0131\u015f\u0131nda icra edilmesi.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>7)<\/strong> B\u00f6lgesel turist rehberlerinin, b\u00f6lgesi d\u0131\u015f\u0131nda turist rehberli\u011fi faaliyetinde bulunmas\u0131.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>8)<\/strong> Se\u00e7imlerin bu Kanuna ve bu Kanun uyar\u0131nca belirlenen kurallara uygun \u015fekilde yap\u0131lmas\u0131n\u0131n engellenmesi.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>9)<\/strong> Ayn\u0131 y\u0131l i\u00e7inde iki kez k\u0131nama cezas\u0131 al\u0131nmas\u0131.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>\u00e7)<\/strong> Meslekten \u00e7\u0131karma cezas\u0131; ruhsatnamesinin geri al\u0131narak turist rehberi unvan\u0131n\u0131n kald\u0131r\u0131lmas\u0131 ve turist rehberinin oda \u00fcyeli\u011finden silinmesidir. Meslekten \u00e7\u0131karma cezas\u0131 a\u015fa\u011f\u0131daki h\u00e2llerde verilir:<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>1)<\/strong> \u00dclke yarar\u0131na ve milli onura ayk\u0131r\u0131 hareket, s\u00f6z ve davran\u0131\u015flarda bulunulmas\u0131.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>2)<\/strong> \u0130ki kez seyahat acental\u0131\u011f\u0131 niteli\u011finde faaliyette bulunulmas\u0131.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>3)<\/strong> Turist rehberi unvan\u0131, ruhsatname veya \u00e7al\u0131\u015fma kart\u0131 kullan\u0131larak su\u00e7 i\u015flendi\u011finin veya i\u015flenmesine yard\u0131m edildi\u011finin mahkeme karar\u0131yla tespit edilmesi.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>4)<\/strong> Mesle\u011fe ili\u015fkin i\u015f ve i\u015flemlerde sahte belge kullan\u0131lmas\u0131 veya yalan beyanda bulunulmas\u0131.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>5)<\/strong> Meslekten ge\u00e7ici men cezas\u0131 uygulanan ilk fiilin i\u015flendi\u011fi tarihten itibaren be\u015f y\u0131l i\u00e7inde toplam\u0131 iki y\u0131l\u0131 a\u015facak \u015fekilde meslekten ge\u00e7ici men cezas\u0131 gerektiren fiillerin i\u015flenmesi.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>6)<\/strong> Kanuni istisnalar sakl\u0131 olmak \u00fczere \u00e7al\u0131\u015fma kart\u0131 almadan turist rehberli\u011fi hizmeti sunuldu\u011funun iki kez tespit edilmesi.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(2)<\/strong> Meslekten ge\u00e7ici men veya \u00e7\u0131karma cezas\u0131 alanlara ili\u015fkin bilgiler ilgili birlik taraf\u0131ndan gecikmeksizin T\u00fcrkiye Seyahat Acentalar\u0131 Birli\u011fine bildirilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(3)<\/strong> Uyarma ve k\u0131nama cezas\u0131n\u0131 gerektiren h\u00e2llerde \u00fcye olunan odan\u0131n y\u00f6netim kurulu; meslekten ge\u00e7ici men ve meslekten \u00e7\u0131karma cezas\u0131n\u0131 gerektiren h\u00e2ller ile oda ve birlik organlar\u0131n\u0131n \u00fcyelerinin fiillerinde ise ilgili birlik y\u00f6netim kurulu taraf\u0131ndan resen veya oda y\u00f6netim kurulunun ba\u015fvurusu \u00fczerine ilgili birlik disiplin kurulu taraf\u0131ndan disiplin soru\u015fturmas\u0131 ba\u015flat\u0131l\u0131r. Fiilin ilgili birli\u011fe bildirilmesinden itibaren bir y\u0131l i\u00e7inde disiplin soru\u015fturmas\u0131 sonu\u00e7land\u0131r\u0131l\u0131r. Disiplin soru\u015fturmas\u0131na ili\u015fkin di\u011fer usul ve esaslar y\u00f6netmelikle d\u00fczenlenir.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Turist Rehberi \u00dccretleri<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>MADDE 6 \u2013 (1)<\/strong> Taban \u00fccret tarifesi, birlikler ile T\u00fcrkiye Seyahat Acentalar\u0131 Birli\u011finin g\u00f6r\u00fc\u015fleri al\u0131narak Bakanl\u0131k taraf\u0131ndan net \u00fccret \u00fczerinden belirlenir ve her y\u0131l 4\/1\/1961 tarihli ve 213 say\u0131l\u0131 Vergi Usul Kanununun m\u00fckerrer 298 inci maddesi h\u00fck\u00fcmleri uyar\u0131nca tespit ve ilan edilen yeniden de\u011ferleme oran\u0131ndan az olmamak kayd\u0131yla art\u0131r\u0131larak en ge\u00e7 aral\u0131k ay\u0131nda, izleyen takvim y\u0131l\u0131n\u0131n ba\u015f\u0131ndan itibaren y\u00fcr\u00fcrl\u00fc\u011fe girmek \u00fczere Bakanl\u0131k taraf\u0131ndan ilan edilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(2)<\/strong> Turist rehberleri, taban \u00fccret tarifesinde belirlenen \u00fccretin alt\u0131nda turist rehberli\u011fi hizmeti sunamazlar. Taban \u00fccret alt\u0131nda \u00e7al\u0131\u015f\u0131labilecek sosyal ve kamusal nitelikli turist rehberli\u011fi hizmetleri y\u00f6netmelikle belirlenir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(3)<\/strong> Turist rehberlerinin tur i\u00e7in belirlenen \u00fccreti ihtiva eden yaz\u0131l\u0131 turist rehberli\u011fi s\u00f6zle\u015fmesi yapmalar\u0131 zorunludur. Hakl\u0131 nedenlerin bulundu\u011fu h\u00e2llerde ve daha sonra yaz\u0131l\u0131 olarak d\u00fczenlenmek kayd\u0131yla e-posta, faks, telefon mesaj\u0131 ve benzeri yollarla s\u00f6zle\u015fme yap\u0131labilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(4)<\/strong> Tur i\u00e7in yaz\u0131l\u0131 s\u00f6zle\u015fme yapmayan veya taban \u00fccretin alt\u0131nda \u00fccret ile \u00e7al\u0131\u015fan turist rehberi, ilgili birlik taraf\u0131ndan her bir fiil i\u00e7in ayr\u0131 ayr\u0131 olmak, birlik b\u00fct\u00e7esine gelir kaydedilmek ve \u00fc\u00e7 g\u00fcnl\u00fck taban \u00fccretinden az olmamak \u00fczere turun toplam s\u00fcresine kar\u015f\u0131l\u0131k gelen taban \u00fccret kadar idari para cezas\u0131yla cezaland\u0131r\u0131l\u0131r.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Mesle\u011fin Korunmas\u0131<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>MADDE 7 \u2013 (1)<\/strong> Turist rehberli\u011fi hizmetleri sadece turist rehberleri taraf\u0131ndan sunulur. Ba\u015fka s\u0131fat veya unvanlarla icra edilen ancak bu Kanun uyar\u0131nca turist rehberli\u011fi niteli\u011fi ta\u015f\u0131yan her t\u00fcrl\u00fc hizmetin y\u00fcr\u00fct\u00fclmesinde mesle\u011fi icra etme ko\u015fullar\u0131n\u0131 ta\u015f\u0131yan ki\u015filer \u00e7al\u0131\u015ft\u0131r\u0131l\u0131r. Kamu kurum ve kurulu\u015flar\u0131n\u0131n resm\u00ee faaliyetlerinde turist rehberli\u011fi hizmeti verecek ruhsatname sahibi bir kamu g\u00f6revlisinin g\u00f6revlendirilmi\u015f olmas\u0131 h\u00e2linde ayr\u0131ca turist rehberi bulundurulmas\u0131 zorunlu de\u011fildir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(2)<\/strong> Bu Kanun kapsam\u0131 d\u0131\u015f\u0131nda hangi ad alt\u0131nda olursa olsun turist rehberli\u011fi niteli\u011finde bir faaliyet y\u00fcr\u00fct\u00fclmesine hak kazand\u0131racak e\u011fitim programlar\u0131 d\u00fczenlenemez veya belge verilemez. Bu h\u00fckme ayk\u0131r\u0131 hareket edenler hakk\u0131nda Bakanl\u0131k taraf\u0131ndan fiilin a\u011f\u0131rl\u0131\u011f\u0131 ile s\u00fcresi dikkate al\u0131narak be\u015fbin T\u00fcrk Liras\u0131ndan onbe\u015fbin T\u00fcrk Liras\u0131na kadar idari para cezas\u0131 uygulan\u0131r. Bu fiillerin i\u015flenmesi durumu mesle\u011fe engel h\u00e2l olu\u015fturur.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(3)<\/strong> Ruhsatname sahibi olmadan turist rehberli\u011fi hizmeti sunanlar bu fiilin tekrar\u0131 h\u00e2linde mesle\u011fe kabul edilmez.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(4)<\/strong> \u0130kinci f\u0131krada yasaklanan fiilleri i\u015fleyenler ile ruhsatname sahibi olmadan veya meslekten ge\u00e7ici olarak men edilmi\u015f veya \u00e7\u0131kar\u0131lm\u0131\u015f olmas\u0131na ra\u011fmen turist rehberli\u011fi hizmeti sunanlar, birlik taraf\u0131ndan veya ilgili m\u00fclki idare amirlerince faaliyetten men edilir ve durum en ge\u00e7 \u00fc\u00e7 g\u00fcn i\u00e7inde Cumhuriyet savc\u0131l\u0131\u011f\u0131na bildirilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(5)<\/strong> Eylemsiz turist rehberlerinden turist rehberli\u011fi hizmeti sunanlar, Bakanl\u0131k taraf\u0131ndan bin be\u015f y\u00fcz T\u00fcrk Liras\u0131 idari para cezas\u0131 ile cezaland\u0131r\u0131l\u0131r.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(6)<\/strong> Bu Kanuna g\u00f6re verilen idari para cezalar\u0131 tebli\u011f tarihinden itibaren bir ay i\u00e7inde tahsil edilir. Bu Kanunda h\u00fck\u00fcm bulunmayan h\u00e2llerde idari para cezalar\u0131 hakk\u0131nda 30\/3\/2005 tarihli ve 5326 say\u0131l\u0131 Kabahatler Kanunu h\u00fck\u00fcmleri uygulan\u0131r.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(7)<\/strong> Turist rehberli\u011fi hizmetleri ile ilgili olarak bu Kanunda \u00f6ng\u00f6r\u00fclen her t\u00fcrl\u00fc denetim, y\u00f6netmelikle belirlenen usul ve esaslar \u00e7er\u00e7evesinde Bakanl\u0131k veya meslek kurulu\u015flar\u0131 taraf\u0131ndan yap\u0131l\u0131r. Denetimlerde i\u015f birli\u011fi yap\u0131lmas\u0131 amac\u0131yla ihtiya\u00e7 duyulmas\u0131 veya T\u00fcrkiye Seyahat Acentalar\u0131 Birli\u011finin talebi h\u00e2linde T\u00fcrkiye Seyahat Acentalar\u0131 Birli\u011finden temsilci al\u0131nabilir. Bakanl\u0131k ve meslek kurulu\u015flar\u0131 gerek g\u00f6rd\u00fc\u011f\u00fcnde kolluk g\u00fc\u00e7lerinden yard\u0131m al\u0131r.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>\u00dc\u00c7\u00dcNC\u00dc B\u00d6L\u00dcM<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Meslek Kurulu\u015flar\u0131<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Meslek Kurulu\u015flar\u0131n\u0131n Nitelikleri, Kurulmas\u0131 ve G\u00f6revleri<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>MADDE 8 \u2013 (1)<\/strong> Bu Kanunda belirtilen g\u00f6revleri yapmak ve yetkileri kullanmak ve odalar\u0131n \u00fcst kurulu\u015fu olmak \u00fczere t\u00fczel ki\u015fili\u011fe sahip ve kamu kurumu niteli\u011finde meslek kurulu\u015fu niteli\u011finde birlikler, T\u00fcrkiye genelinde kay\u0131tl\u0131 toplam meslek mensubu say\u0131s\u0131n\u0131n y\u00fczde otuz\u00fc\u00e7\u00fcne sahip odalar\u0131n Bakanl\u0131\u011fa yapacaklar\u0131 ba\u015fvuru \u00fczerine kurulabilir. Birden fazla meslek birli\u011fi kurulabilir. Ba\u015fvuru ile ilgili usul ve esaslar y\u00f6netmelikle d\u00fczenlenir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(2)<\/strong> S\u0131n\u0131rlar\u0131 i\u00e7inde en az y\u00fczelli turist rehberinin yerle\u015fim yerinin bulundu\u011fu her ilde, o ilde kay\u0131tl\u0131 toplam meslek mensubu say\u0131s\u0131n\u0131n y\u00fczde otuz \u00fc\u00e7\u00fcn\u00fcn valili\u011fe ba\u015fvurusu \u00fczerine t\u00fczel ki\u015fili\u011fe sahip ve kamu kurumu niteli\u011finde meslek kurulu\u015fu olan oda kurulabilir. Odalar\u0131n merkezleri kurulduklar\u0131 ildir. Ayn\u0131 ilde birden fazla oda kurulabilir. Odalar\u0131n yetki \u00e7evresi co\u011frafi olarak yak\u0131n iller ve \u00e7al\u0131\u015fma b\u00f6lgesi dikkate al\u0131narak Bakanl\u0131k taraf\u0131ndan belirlenir. Ancak oda olmayan illerde en az elli turist rehberinin oda merkezinin bulunaca\u011f\u0131 ili belirten ba\u015fvurusu \u00fczerine Bakanl\u0131k taraf\u0131ndan t\u00fczel ki\u015fili\u011fe sahip kamu kurumu niteli\u011finde meslek kurulu\u015fu olan b\u00f6lgesel odalar kurulabilir. Odalar, birli\u011fin \u00fcyesidir. \u00dcye say\u0131s\u0131 ellinin veya il baz\u0131nda kay\u0131tl\u0131 olan toplam turist rehberi say\u0131s\u0131n\u0131n en az y\u00fczde yirmisinin alt\u0131na d\u00fc\u015fen odalar, bu durumun tespit edildi\u011fi tarihten itibaren alt\u0131 ayl\u0131k s\u00fcre sonunda da devam etmesi h\u00e2linde; iki mali y\u0131l \u00fcst \u00fcste bilan\u00e7osu menfi bakiye veren odalar ise ikinci bilan\u00e7onun a\u00e7<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\">\u0131klanmas\u0131n\u0131 m\u00fcteakiben ilgili birlik y\u00f6netim kurulunun karar\u0131yla kapat\u0131larak tasfiye edilir ve tasfiye sonucunda kalan malvarl\u0131\u011f\u0131 ilgili birli\u011fe devredilir. B\u00f6lgesel odalar, odalar hakk\u0131ndaki h\u00fck\u00fcmlere tabidir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(3)<\/strong> Meslek kurulu\u015flar\u0131n\u0131n g\u00f6rev ve yetkileri \u015funlard\u0131r:<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>a)<\/strong> \u00dcyelerinin m\u00fc\u015fterek ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lamak ve mesleki faaliyetlerini kolayla\u015ft\u0131rmak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>b)<\/strong> Mesle\u011fin genel menfaatlerine ve ulusal turizm ve tan\u0131t\u0131m politikalar\u0131na uygun olarak ifa edilmesini ve geli\u015fmesini sa\u011flamak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>c)<\/strong> Meslek mensuplar\u0131n\u0131n birbirleri ve halkla olan ili\u015fkileri ile mesle\u011fin icras\u0131nda d\u00fcr\u00fcstl\u00fc\u011f\u00fc ve g\u00fcveni hakim k\u0131lmak \u00fczere; meslek eti\u011fini ve disiplini korumak, turist rehberleri aras\u0131ndaki haks\u0131z rekabetin \u00f6nlenmesi hususunda gerekli tedbirleri almak, turist rehberlerinin yeti\u015ftirilmesi i\u00e7in kurs, seminer ve e\u011fitim programlar\u0131 d\u00fczenlemek, meslek konusunda ara\u015ft\u0131rma ve incelemeler yapmak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>\u00e7)<\/strong> Bakanl\u0131k\u00e7a istenilen konularda g\u00f6r\u00fc\u015f bildirmek.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>d)<\/strong> Bu Kanun ve ilgili mevzuatta belirtilen g\u00f6revleri yerine getirmek.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(4)<\/strong> Birlik, odalara s\u0131n\u0131rlar\u0131n\u0131 a\u00e7\u0131k\u00e7a belirlemek \u015fart\u0131yla yetki devri yapabilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(5)<\/strong> Birlik y\u00f6netim kurulu, oda bulunmayan illerde temsilcilik a\u00e7abilir veya talepleri h\u00e2linde odalara temsilcilik a\u00e7ma yetkisi verebilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(6)<\/strong> Meslek kurulu\u015flar\u0131, faaliyetlerini gerekti\u011finde turizm sekt\u00f6r\u00fcndeki \u00f6zel veya resm\u00ee kurum ve kurulu\u015flarla i\u015f birli\u011fi i\u00e7erisinde y\u00fcr\u00fctebilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(7)<\/strong> Bakanl\u0131k, turist rehberli\u011fi hizmetleri ve ilgili her t\u00fcrl\u00fc faaliyetin bu Kanun ve ilgili mevzuatta belirtilen usul ve esaslar \u00e7er\u00e7evesinde icra edilmesini sa\u011flamak ve mevzuata ayk\u0131r\u0131 \u015fekilde icra edilmesini \u00f6nlemek amac\u0131yla, gerekti\u011finde meslek kurulu\u015flar\u0131yla i\u015f birli\u011fi yaparak gerekli tedbirleri al\u0131r.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(8)<\/strong> Birlikler, faaliyet alan\u0131 ile ilgili ulusal ve uluslararas\u0131 kurulu\u015flara \u00fcye olabilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\">(9) Bu Kanun h\u00fck\u00fcmleri d\u0131\u015f\u0131nda meslek kurulu\u015fu kurulamaz.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Denetim ve G\u00f6zetim<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>MADDE 9 \u2013 (1)<\/strong> Bakanl\u0131k, meslek kurulu\u015flar\u0131n\u0131n her t\u00fcrl\u00fc i\u015f, i\u015flem, faaliyet ve hesaplar\u0131n\u0131 denetleme yetkisini haizdir. Meslek kurulu\u015flar\u0131 denetim esnas\u0131nda her t\u00fcrl\u00fc bilgiyi vermek ve belgeyi g\u00f6stermekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Meslek Kurulu\u015flar\u0131n\u0131n Organlar\u0131, Se\u00e7imleri, G\u00f6rev ve Yetkileri<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>MADDE 10 \u2013 (1)<\/strong> Odalar\u0131n organlar\u0131 genel kurul, y\u00f6netim kurulu ve denetim kurulu; birliklerin organlar\u0131 genel kurul, y\u00f6netim kurulu, denetim kurulu ve disiplin kuruludur.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(2)<\/strong> Oda genel kurulu, en az alt\u0131 ayd\u0131r eylemli olan oda \u00fcyesi turist rehberlerinden; birlik genel kurulu oda ba\u015fkanlar\u0131 ile her oda genel kurulunun kendi \u00fcyeleri aras\u0131ndan her elli \u00fcyesi i\u00e7in bir delege olmak ve \u00fc\u00e7 y\u0131l g\u00f6rev yapmak \u00fczere se\u00e7ece\u011fi delegelerden olu\u015fur. Ayr\u0131ca, delege say\u0131s\u0131 kadar, delege s\u0131fat\u0131n\u0131n yitirildi\u011fi h\u00e2llerde se\u00e7ilme s\u0131ralar\u0131 esas al\u0131narak o g\u00f6rev d\u00f6nemini tamamlamak \u00fczere yedek delege se\u00e7ilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(3)<\/strong> Meslek kurulu\u015flar\u0131 genel kurullar\u0131n\u0131n g\u00f6rev ve yetkileri \u015funlard\u0131r:<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>a)<\/strong> Y\u00f6netim kurulunun ge\u00e7mi\u015f d\u00f6nem faaliyetleri ile bilan\u00e7osunu g\u00f6steren raporun, bilan\u00e7o gelir ve gider hesaplar\u0131n\u0131n okunup m\u00fczakere edilerek kabul\u00fc veya reddine, y\u00f6netim kurulunun ibra edilip edilmemesine ve denetim kurulu raporunun okunarak kabul edilip edilmemesine ve denetim kurulu \u00fcyelerinin ibra edilip edilmemesine karar vermek.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>b)<\/strong> Yeni d\u00f6nem \u00e7al\u0131\u015fma program\u0131n\u0131n ve y\u00f6netim kurulu taraf\u0131ndan haz\u0131rlanan tahmini b\u00fct\u00e7enin g\u00f6r\u00fc\u015f\u00fclerek kabul\u00fcne veya reddine karar vermek.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>c)<\/strong> \u0130htiya\u00e7 duyulan ta\u015f\u0131nmazlar\u0131n sat\u0131n al\u0131nmas\u0131 veya mevcut ta\u015f\u0131nmazlar\u0131n sat\u0131lmas\u0131 veya \u00fczerinde ipotek d\u00e2hil ayni hak tesis edilmesi hususunda y\u00f6netim kuruluna yetki vermek.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>\u00e7)<\/strong> Sermaye \u015firketi, kooperatif veya vak\u0131f kurma ya da kurulu bulunanlara kat\u0131lma karar\u0131 almak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>d)<\/strong> \u0130\u015f, i\u015flem veya faaliyetleri nedeniyle hukuki veya cezai sorumlulu\u011fu tespit edilen organ \u00fcyeleri hakk\u0131nda dava a\u00e7\u0131lmas\u0131na ve bunlar\u0131n g\u00f6revde kal\u0131p kalmamas\u0131na karar vermek.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>e)<\/strong> Y\u00f6netim kurulu taraf\u0131ndan sunulan hususlar\u0131 g\u00f6r\u00fc\u015f\u00fcp karara ba\u011flamak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>f)<\/strong> Ola\u011fan toplant\u0131larda, kat\u0131lanlar\u0131n be\u015fte biri taraf\u0131ndan g\u00f6r\u00fc\u015f\u00fclmesi, g\u00fcndemden \u00e7\u0131kar\u0131lmas\u0131 veya g\u00fcndeme al\u0131nmas\u0131 \u00f6nerilen konular\u0131 g\u00fcndeme almak, g\u00fcndemden \u00e7\u0131karmak veya g\u00f6r\u00fc\u015ferek karara ba\u011flamak.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>g)<\/strong> Bu Kanun ve di\u011fer mevzuatla verilen g\u00f6revleri yerine getirmek.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(4)<\/strong> Genel kurul, genel kurul \u00fcyelerinin d\u00f6rtte birinin noter onayl\u0131 yaz\u0131l\u0131 ba\u015fvurusu \u00fczerine y\u00f6netim kurulu taraf\u0131ndan ola\u011fan\u00fcst\u00fc toplant\u0131ya \u00e7a\u011fr\u0131l\u0131r. Ola\u011fan\u00fcst\u00fc toplant\u0131da \u00e7a\u011fr\u0131da belirlenen g\u00fcndem d\u0131\u015f\u0131nda g\u00f6r\u00fc\u015fme yap\u0131lamaz. Ola\u011fan\u00fcst\u00fc toplant\u0131yla ilgili her t\u00fcrl\u00fc i\u015flem ve faaliyetler y\u00f6netim kurulunca y\u00fcr\u00fct\u00fcl\u00fcr. Y\u00f6netim kurulunun hakl\u0131 nedenlerle bu g\u00f6revi yerine getirememesi h\u00e2linde bu i\u015flem ve faaliyetlerin kimler taraf\u0131ndan y\u00fcr\u00fct\u00fclece\u011fi odalarda birlik taraf\u0131ndan, birlikte ise Bakanl\u0131k taraf\u0131ndan belirlenir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(5)<\/strong> Meslek kurulu\u015flar\u0131n\u0131n genel kurullar\u0131n\u0131n \u00e7al\u0131\u015fma usul ve esaslar\u0131 y\u00f6netmelikle belirlenir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(6)<\/strong> Ba\u015fkanlar\u0131n se\u00e7imine ve y\u00f6netim kurullar\u0131n\u0131n olu\u015fumuna ve \u00e7al\u0131\u015fmas\u0131na ili\u015fkin usul ve esaslar a\u015fa\u011f\u0131da g\u00f6sterilmi\u015ftir:<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>a)<\/strong> Meslek kurulu\u015flar\u0131n\u0131n y\u00f6netim kurullar\u0131, ba\u015fkan d\u00e2hil olmak \u00fczere be\u015f as\u0131l \u00fcyeden olu\u015fur. Oda y\u00f6netim kurullar\u0131nda as\u0131l \u00fcye say\u0131s\u0131 odaya \u00fcye her ikiy\u00fcz turist rehberi i\u00e7in birer ki\u015fi art\u0131r\u0131l\u0131r, ancak y\u00f6netim kurulu as\u0131l \u00fcye say\u0131s\u0131 ba\u015fkan d\u00e2hil olmak \u00fczere dokuzu a\u015famaz. Ba\u015fkan ve y\u00f6netim kurulu \u00fcyeleri \u00fc\u00e7 y\u0131ll\u0131k s\u00fcre i\u00e7in se\u00e7ilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>b)<\/strong> Oda ba\u015fkanlar\u0131 ile oda y\u00f6netim kurulunun as\u0131l ve yedek \u00fcyeleri oda genel kurulu taraf\u0131ndan oda \u00fcyesi eylemli turist rehberleri aras\u0131ndan, birlik ba\u015fkan\u0131 ile birlik y\u00f6netim kurulunun as\u0131l ve yedek \u00fcyeleri birlik genel kurulu taraf\u0131ndan birlik genel kurul \u00fcyeleri aras\u0131ndan se\u00e7ilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>c)<\/strong> Se\u00e7imlerde her \u00fcyenin aday olma hakk\u0131 vard\u0131r. Oy pusulalar\u0131nda aday olanlar\u0131n adlar\u0131 alfabetik s\u0131raya g\u00f6re s\u0131ralan\u0131r. Oy pusulalar\u0131 adaylar\u0131n adlar\u0131 yan\u0131na i\u015faret konacak kare \u015feklindeki kutulara yer verilmek suretiyle \u00e7o\u011falt\u0131l\u0131r ve il\u00e7e se\u00e7im kurulu m\u00fchr\u00fc ile m\u00fch\u00fcrlendikten sonra kullan\u0131l\u0131r. Oylar pusulada yer alan adaylardan se\u00e7ilecek \u00fcye veya temsilcilik say\u0131s\u0131nca aday\u0131n ismi yan\u0131ndaki kutu i\u015faretlenmek suretiyle kullan\u0131l\u0131r. Oy verme i\u015flemi gizli oy, a\u00e7\u0131k tasnif esaslar\u0131na g\u00f6re yap\u0131l\u0131r. \u00dcye listesinde ad\u0131 yaz\u0131l\u0131 bulunmayan meslek mensuplar\u0131 oy kullanamaz. Oylar, oy verenin kimli\u011fini resm\u00ee kurulu\u015flarca verilen belgeyle ispat etmesinden ve listedeki isminin kar\u015f\u0131s\u0131ndaki yeri imzalamas\u0131ndan sonra kullan\u0131l\u0131r. Oylar, \u00fczerinde il\u00e7e se\u00e7im kurulu m\u00fchr\u00fc bulunan ve oy verme s\u0131ras\u0131nda sand\u0131k kurulu ba\u015fkan\u0131 taraf\u0131ndan verilen zarflara konulmak suretiyle kullan\u0131l\u0131r. Se\u00e7ilecek ki\u015fi say\u0131s\u0131ndan fazla aday\u0131n i\u015faretlendi\u011fi veya m\u00fch\u00fcrs\u00fcz oy pusulas\u0131 ve zarfla kullan\u0131lan oylar ge\u00e7ersiz say\u0131l\u0131r.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>\u00e7)<\/strong> Se\u00e7ime kat\u0131lan adaylar\u0131n adlar\u0131 alt alta ve ald\u0131klar\u0131 ge\u00e7erli oy adlar\u0131n\u0131n hizalar\u0131na yaz\u0131l\u0131r. Adaylar\u0131n ald\u0131klar\u0131 oylar en b\u00fcy\u00fckten en k\u00fc\u00e7\u00fc\u011fe do\u011fru s\u0131ralan\u0131r. As\u0131l ve yedek \u00fcyelikler, adaylara rakamlar\u0131n\u0131n b\u00fcy\u00fckl\u00fck s\u0131ras\u0131na g\u00f6re tahsis olunur. Sona kalan \u00fcye veya temsilcilik i\u00e7in oylar\u0131n e\u015fit olmas\u0131 h\u00e2linde, bunlar\u0131n aras\u0131nda ad \u00e7ekilmek suretiyle tahsis yap\u0131l\u0131r.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>d)<\/strong> Y\u00f6netim kurullar\u0131 en az ayda bir kez toplan\u0131r. Ba\u015fkanl\u0131k s\u0131fat\u0131 d\u00e2hil y\u00f6netim kurulu \u00fcyeli\u011fi \u00f6l\u00fcm, istifa, g\u00f6revi yerine getirmeye engel hastal\u0131k, meslekten \u00e7\u0131karma veya mazeretsiz olarak \u00fc\u00e7 kere \u00fcst \u00fcste toplant\u0131ya kat\u0131lmama h\u00e2llerinde sona erer. Ba\u015fkanl\u0131k s\u0131fat\u0131n\u0131n yitirildi\u011fi h\u00e2llerde, y\u00f6netim kurulu as\u0131l \u00fcyeleri kendi aralar\u0131ndan g\u00f6rev s\u00fcresini tamamlamak \u00fczere bir ba\u015fkan se\u00e7er. Ba\u015fkan se\u00e7ilen as\u0131l \u00fcyenin yerine se\u00e7ilme s\u0131ras\u0131na g\u00f6re birinci yedek \u00fcye as\u0131l \u00fcyelik s\u0131fat\u0131n\u0131 kazan\u0131r. Birlik ba\u015fkan\u0131 se\u00e7ilen oda ba\u015fkan\u0131 oda ba\u015fkanl\u0131\u011f\u0131 s\u0131fat\u0131n\u0131 yitirir. Ayn\u0131 ki\u015fi, \u00fcst \u00fcste iki d\u00f6nemden fazla ba\u015fkan olarak se\u00e7ilemez. Denetim kurullar\u0131 en az ayda bir toplan\u0131r ve yapt\u0131klar\u0131 denetim sonu\u00e7lar\u0131n\u0131 \u00fc\u00e7 ayda bir y\u00f6netim kuruluna ve d\u00f6nem sonunda da genel kurula rapor h\u00e2linde sunar. Denetim kurulu \u00fcyeli\u011fi \u00f6l\u00fcm, istifa, g\u00f6revi yerine getirmeye engel hastal\u0131k, meslekten \u00e7\u0131karma veya mazeretsiz olarak \u00fcst \u00fcste \u00fc\u00e7 toplant\u0131ya kat\u0131lmama h\u00e2llerinde sona erer. Bu durumda, yedek \u00fcyelerden en fazla oy alan \u00fcye denetim kurulunca yaz\u0131l\u0131 olarak g\u00f6reve \u00e7a\u011fr\u0131l\u0131r. Denetim kurulu as\u0131l veya yedek \u00fcyelerinin, kurulun karar yeter say\u0131s\u0131n\u0131n alt\u0131na d\u00fc\u015fmesi sonucunu do\u011furacak \u015fekilde istifas\u0131 h\u00e2linde ilk genel kurul toplant\u0131s\u0131na kadar odalarda birlik, birlikte Bakanl\u0131k taraf\u0131ndan bir denet\u00e7i atan\u0131r.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>b)<\/strong> Denetim kurullar\u0131, ola\u011fan genel kurul toplant\u0131s\u0131ndan en az bir ay \u00f6ncesinde ve ba\u015fkan\u0131n uygun g\u00f6rece\u011fi di\u011fer tarihlerde denetim yapar. Yap\u0131lan her denetim sonucunda bir denetim raporu d\u00fczenlenir. Denetim raporu sadece hukuka ve mali kurallara uygunluk hususlar\u0131nda oy \u00e7oklu\u011fuyla d\u00fczenlenir, muhalif \u00fcyeler gerek\u00e7elerini rapora eklemek zorundad\u0131r. Denetim raporlar\u0131 genel kurul toplant\u0131s\u0131ndan en az bir hafta \u00f6nce genel kurul \u00fcyelerinin incelemesine sunulur ve genel kurulda okunur. Birlik disiplin kurulu, turist rehberlerinin disiplin i\u015flemlerini bu Kanun ve ilgili mevzuatta \u00f6ng\u00f6r\u00fclen usul ve esaslar \u00e7er\u00e7evesinde y\u00fcr\u00fct\u00fcr. Birlik disiplin kurulu, \u00fcye tam say\u0131s\u0131n\u0131n salt \u00e7o\u011funlu\u011fuyla karar al\u0131r. Bir yerde birden fazla il\u00e7e se\u00e7im kurulu bulundu\u011fu takdirde g\u00f6revli il\u00e7e se\u00e7im kurulu, il se\u00e7im kurulunca belirlenir. \u0130l\u00e7e se\u00e7im kurulu ba\u015fkanl\u0131\u011f\u0131, gerekti\u011finde ilgili kay\u0131t ve belgeleri de getirtip incelemek suretiyle varsa noksanlar\u0131 tamamlatt\u0131rd\u0131ktan sonra genel kurula kat\u0131lma hakk\u0131na sahip olanlar\u0131 belirleyen listeyi ba\u015fvuru tarihini izleyen on g\u00fcn i\u00e7inde onaylar. Bu s\u00fcre i\u00e7inde onay verilmemesi h\u00e2linde sunulan liste kesinle\u015fmi\u015f say\u0131l\u0131r. Onaylanan veya kesinle\u015fmi\u015f say\u0131lan liste, ilgisine g\u00f6re birlik veya odan\u0131n merkezindeki ilan tahtas\u0131nda ve elektronik ortamda yedi g\u00fcn s\u00fcreyle ilan edilir. Birlik genel kurullar\u0131 taraf\u0131ndan se\u00e7im yap\u0131ld\u0131\u011f\u0131 takdirde ayn\u0131 s\u00fcre i\u00e7inde odalara yaz\u0131l\u0131 bildirim yap\u0131l\u0131r. \u0130lan s\u00fcresini veya yaz\u0131l\u0131 bildirim h\u00e2linde bildirimi izleyen \u00fc\u00e7 g\u00fcn i\u00e7inde il\u00e7e se\u00e7im kuruluna itiraz edilebilir. \u0130tirazlar il\u00e7e se\u00e7im kurulu taraf\u0131ndan incelenir ve en ge\u00e7 yedi g\u00fcn i\u00e7inde kesin olarak karara ba\u011flan\u0131r. Bu suretle kesinle\u015fen listeler se\u00e7imin yap\u0131laca\u011f\u0131 meslek kurulu\u015funa g\u00f6nderilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>c)<\/strong> Y\u00f6netim kurulunca se\u00e7im yap\u0131lan h\u00e2llerde, toplant\u0131dan yedi g\u00fcn \u00f6nce se\u00e7imi yapan meslek kurulu\u015funun merkezinin bulundu\u011fu il\u00e7e se\u00e7im kurulu ba\u015fkanl\u0131\u011f\u0131na ba\u015fvurulur.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>\u00e7)<\/strong> Se\u00e7imde g\u00f6revli h\u00e2kimlere 26\/4\/1961 tarihli ve 298 say\u0131l\u0131 Se\u00e7imlerin Temel H\u00fck\u00fcmleri ve Se\u00e7men K\u00fct\u00fckleri Hakk\u0131nda Kanuna g\u00f6re \u00fccret \u00f6denir. Kurulu\u015f ama\u00e7lar\u0131 d\u0131\u015f\u0131nda faaliyet g\u00f6steren veya bu Kanunda belirtilen asli g\u00f6revlerini Bakanl\u0131\u011f\u0131n uyar\u0131s\u0131na ra\u011fmen yerine getirmeyen meslek kurulu\u015flar\u0131n\u0131n sorumlu organlar\u0131n\u0131n g\u00f6revlerine son verilmesine Bakanl\u0131\u011f\u0131n veya bu kurulu\u015flar\u0131n bulunduklar\u0131 yer Cumhuriyet savc\u0131l\u0131\u011f\u0131n\u0131n istemi \u00fczerine o yerdeki asliye hukuk mahkemesince karar verilir. G\u00f6revlerine son verilen organlar\u0131n yerine bu Kanun ve ilgili mevzuattaki usul ve esaslara g\u00f6re en ge\u00e7 \u00fc\u00e7 ay i\u00e7inde yap\u0131lacak genel kurul toplant\u0131s\u0131na kadar, odalar birlik taraf\u0131ndan, birlik ise Bakanl\u0131k taraf\u0131ndan g\u00f6revlendirilen \u00fc\u00e7 ki\u015filik kurul taraf\u0131ndan y\u00f6netilir. G\u00f6revlerine son verilen organ \u00fcyelerinin her t\u00fcrl\u00fc hukuki ve cezai sorumluluklar\u0131 sakl\u0131d\u0131r. Organlar\u0131n bu f\u0131kra h\u00fck\u00fcmleri gere\u011fince g\u00f6revlerine son verilmesine neden olan ve mahkeme karar\u0131nda belirtilen tasarruflar\u0131 h\u00fck\u00fcms\u00fczd\u00fcr.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(17)<\/strong> Meslek kurulu\u015flar\u0131n\u0131n hukuki temsilcileri ba\u015fkanlar\u0131d\u0131r. Ba\u015fkan\u0131n teklifi \u00fczerine y\u00f6netim kurulu kendi \u00fcyeleri aras\u0131ndan en fazla iki ba\u015fkan yard\u0131mc\u0131s\u0131 se\u00e7er. Ba\u015fkan yard\u0131mc\u0131lar\u0131 ba\u015fkan\u0131n verdi\u011fi yetki d\u00e2hilinde veya ba\u015fkan\u0131n yoklu\u011fu h\u00e2linde ba\u015fkan\u0131n g\u00f6revlerini yerine getirirler. Ba\u015fkan, genel kurul ile y\u00f6netim kurulunun yetkileri sakl\u0131 olmak \u00fczere, meslek kurulu\u015fu ad\u0131na d\u00fczenlenen taahh\u00fctname, s\u00f6zle\u015fme ve vek\u00e2let gibi meslek kurulu\u015funu hukuken ba\u011flayan hukuki i\u015flemleri yapmaya yetkilidir. Ba\u015fkan bu yetkisinin ba\u015fkan yard\u0131mc\u0131lar\u0131ndan birinin, y\u00f6netim kurulunun bir \u00fcyesinin veya genel sekreterin imzas\u0131yla m\u00fc\u015fterek olarak kullan\u0131lmas\u0131na karar verebilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(18)<\/strong> Meslek kurulu\u015flar\u0131 b\u00fcnyesinde kurulan hizmet birimleri ile bunlar\u0131n g\u00f6rev ve yetkileri, genel kurul taraf\u0131ndan karara ba\u011flan\u0131r. \u0130dari i\u015fleri y\u00fcr\u00fctmek \u00fczere bir genel sekreter, en fazla iki genel sekreter yard\u0131mc\u0131s\u0131 ile yeterli say\u0131da \u00e7al\u0131\u015fandan olu\u015fan genel sekreterlik olu\u015fturulur. Genel sekreter ba\u015fkan\u0131n teklifi \u00fczerine y\u00f6netim kurulu taraf\u0131ndan, genel sekreter yard\u0131mc\u0131lar\u0131 ise genel sekreterin teklifi \u00fczerine ba\u015fkan taraf\u0131ndan atan\u0131r. Genel sekreterin y\u00fcr\u00fctece\u011fi i\u015f, sorumluluk, g\u00f6rev ve yetkileri y\u00f6netim kurulu taraf\u0131ndan, genel sekreter yard\u0131mc\u0131lar\u0131n\u0131n ise genel sekreter taraf\u0131ndan belirlenir. Ba\u015fkan, idari i\u015flere ili\u015fkin tek ba\u015f\u0131na sahip oldu\u011fu karar ve imza yetkilerinden gerekli g\u00f6rd\u00fcklerini genel sekretere devredebilir. Hizmet birimlerinde \u00e7al\u0131\u015ft\u0131r\u0131lan personelin \u00fccretleri ile mali ve sosyal haklar\u0131 y\u00f6netim kurulu taraf\u0131ndan belirlenir.<\/span><\/p>\n<p><span yaz\u0131l\u0131 rehberlik s\u00f6zle\u015fmesi yapmayan veya taban \u00fccretin alt\u0131nda \u00fccret ile rehber \u00e7al\u0131\u015ft\u0131ran seyahat acentas\u0131na her bir fiil i\u00e7in ayr\u0131 ayr\u0131 olmak \u00fczere bin T\u00fcrk Liras\u0131.\u201d<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Sakl\u0131 Tutulan Haklar<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>GE\u00c7\u0130C\u0130 MADDE 1 \u2013 (1)<\/strong> Bu Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarih itibar\u0131yla rehberlik kimlik kart\u0131na sahip olanlar\u0131n haklar\u0131, bu Kanunun 3 \u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131n\u0131n (a), (e) ve (f) bentlerinde \u00f6ng\u00f6r\u00fclen ko\u015fullar\u0131 ta\u015f\u0131malar\u0131 ve bu Kanuna g\u00f6re kurulan ilgili odaya kurulu\u015f tarihinden itibaren alt\u0131 ay i\u00e7inde kaydolmalar\u0131 \u015fart\u0131yla sakl\u0131d\u0131r. Ancak ba\u015fvuruda bulunan rehberlerin rehberlik kimlik kartlar\u0131 ruhsatname ile de\u011fi\u015ftirilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(2)<\/strong> B\u00f6lgesel rehberlik kimlik kart\u0131na sahip olan rehberler, bu Kanuna g\u00f6re kurulan ilgili odaya kurulu\u015f tarihinden itibaren alt\u0131 ay i\u00e7inde kaydolmak \u015fart\u0131yla sadece rehberlik kimlik kart\u0131nda belirtilen b\u00f6lgede, dil veya dillerde faaliyet g\u00f6sterebilirler.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(3)<\/strong> Bu Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihte Bakanl\u0131k taraf\u0131ndan a\u00e7\u0131lm\u0131\u015f olan rehberlik kurslar\u0131na kaydolanlar, s\u00fcresine ve niteli\u011fine bak\u0131lmaks\u0131z\u0131n bu e\u011fitimi tamamlamalar\u0131 ve bu Kanunun 3 \u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131nda \u00f6ng\u00f6r\u00fclen ko\u015fullar\u0131 ta\u015f\u0131malar\u0131 kayd\u0131yla mesle\u011fe kabul edilir.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(4)<\/strong> \u00dclkesel veya b\u00f6lgesel rehberlik kimlik kart\u0131na sahip iken, vize y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirmemesi veya kamu kurum ve kurulu\u015flar\u0131nda \u00e7al\u0131\u015fmalar\u0131 ya da ilgili mevzuatlar\u0131 gere\u011fi ba\u015fka i\u015f ve hizmet yasa\u011f\u0131 nedeniyle meslekten men edilenler, meslekten \u00e7\u0131kar\u0131lanlar veya rehberlik kimlik kart\u0131 iptal edilenler, bir y\u0131l i\u00e7inde Bakanl\u0131\u011fa ba\u015fvurmalar\u0131, bu Kanunun 3 \u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131n\u0131n (a), (b) ve (e) bentlerinde \u00f6ng\u00f6r\u00fclen ko\u015fullar\u0131 ta\u015f\u0131malar\u0131 ve Bakanl\u0131k taraf\u0131ndan yap\u0131lan s\u0131navda ba\u015far\u0131l\u0131 olmalar\u0131 kayd\u0131yla mesle\u011fe kabul edilir.<\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>Se\u00e7im ve Devir \u0130\u015flemleri<\/strong><\/span><\/p>\n<p><span style=\"font-family: verdana, geneva, sans-serif;\"><strong>GE\u00c7\u0130C\u0130 MADDE 2 \u2013 (1)<\/strong> Bu Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihte 7\/6\/2005 tarihli ve 5362 say\u0131l\u0131 Esnaf ve Sanatkarlar Meslek Kurulu\u015flar\u0131 Kanununa g\u00f6re kurulmu\u015f bulunan rehberlik meslek kurulu\u015flar\u0131, t\u00fcm alacak, bor\u00e7 ve malvarl\u0131klar\u0131yla birlikte bu Kanun h\u00fck\u00fcmlerine tabi rehber odas\u0131 niteli\u011fini kazan\u0131rlar ve faaliyetlerini bu Kanuna tabi olarak y\u00fcr\u00fct\u00fcrler. Bu kurulu\u015flar\u0131n bu Kanun uyar\u0131nca yap\u0131lmas\u0131 gerekli organ se\u00e7imleri, bu Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren \u00fc\u00e7 ay i\u00e7inde yap\u0131l\u0131r. Bu kurulu\u015flar bor\u00e7tan ar\u00ee malvarl\u0131klar\u0131n\u0131n y\u00fczde yirmisini veya buna kar\u015f\u0131l\u0131k gelen nakit mebla\u011f\u0131 birlik organlar\u0131n\u0131n se\u00e7imini izleyen \u00fc\u00e7 ay i\u00e7inde birli\u011fe devrederler.<\/span><br \/>\n<span style=\"font-family: verdana, geneva, sans-serif;\"><strong>(2)<\/strong> Bu Kanunda \u00f6ng\u00f6r\u00fclen se\u00e7imler, bu Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren bir y\u0131l i\u00e7inde tamamlan\u0131r.
